1. Acceptance of Terms

By downloading, installing, or using Nail Bite Beaver ("the Software"), you agree to be bound by these Terms of Use. If you do not agree to these terms, do not use the Software.

2. Age Requirement

You must be of legal age in your jurisdiction to use Nail Bite Beaver. By purchasing or using the Software, you confirm that you meet the minimum age requirement under applicable law in your country or region. The developer assumes no responsibility for use of the Software by minors and disclaims all liability arising from underage access.

3. Description of the Software

Nail Bite Beaver is a novelty macOS application that uses your Mac’s camera to detect nail-biting or hand-to-face movement on-device, then shows an on-screen beaver reminder — including overlays that may briefly cover part or all of your display. The Software is provided as a personal habit reminder and entertainment tool. It is not, and is not represented to be, a medical device, clinical treatment, therapy, or guaranteed cure for nail-biting or related behaviors.

4. Camera & Detection Disclaimer

You use Nail Bite Beaver entirely at your own risk. The Software requires camera access and continuously samples video frames while monitoring is enabled. Detection is heuristic and imperfect. The Software may:

• Miss real nail-biting or hand-to-face behavior (false negatives)
• Trigger when you are not biting your nails — for example while eating, resting your chin, adjusting glasses, applying makeup, or gesturing near your face (false positives)
• Interrupt your screen during video calls, presentations, gaming, or other focused work when an overlay appears
• Use additional CPU, GPU, Neural Engine, and battery while the camera and on-device models are active

You are solely responsible for deciding when monitoring is appropriate, for pausing or quitting the Software when an interruption would be harmful or inappropriate, and for any consequence of a missed or incorrect detection.

5. Limitation of Liability

To the maximum extent permitted by applicable law, the developer shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising out of or in connection with your use of the Software, including but not limited to damages for loss of profits, data, goodwill, productivity, or other intangible losses, even if the developer has been advised of the possibility of such damages.

In no event shall the developer's total liability exceed the amount you paid for the Software.

6. No Warranty

The Software is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. The developer does not warrant that the Software will be uninterrupted, error-free, accurate in every detection, or free of harmful components.

7. Assumption of Risk

You expressly acknowledge and agree that use of the Software involves continuous camera monitoring and on-screen interruptions. You assume all risk of embarrassment, disruption, missed work, or loss that may result from using the Software as intended or otherwise.

8. Disclaimer of Liability for Social and Professional Consequences

The developer shall not be held liable for any social, professional, reputational, or personal consequences arising from the use of the Software in any setting, including but not limited to workplaces, educational institutions, public spaces, video calls, streams, or private gatherings. Without limiting the generality of the foregoing, the developer expressly disclaims responsibility for any adverse outcomes including but not limited to termination of employment, disciplinary action, loss of professional standing, damage to personal or business relationships, ejection from premises, or public embarrassment resulting from the beaver overlay, detection alerts, or other visual effects produced by the Software. You acknowledge that you are solely responsible for exercising appropriate judgment regarding when, where, and in whose presence you choose to operate the Software.

9. Lawful Use of the Camera

You agree to use the Software only on devices you own or are expressly authorized to use, and only in a manner consistent with all applicable laws and regulations governing cameras, workplace monitoring, and privacy. You are solely responsible for ensuring that running the Software (including facing a webcam toward yourself or others nearby) is lawful in your location and setting. The developer is not responsible for unlawful use and you agree to indemnify the developer in accordance with Section 10.

10. Indemnification

You agree to indemnify, defend, and hold harmless the developer from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to your use of the Software or violation of these Terms.

11. License

Nail Bite Beaver grants you a personal, non-transferable, non-exclusive, revocable license to use the Software on devices you own or control, subject to a valid license obtained through our authorized payment provider (Lemon Squeezy) or the Mac App Store, as applicable. You may not redistribute, reverse-engineer, decompile, or create derivative works based on the Software, except to the extent such restriction is prohibited by applicable law.

12. Intellectual Property

The Nail Bite Beaver name, logo, beaver artwork, brand colors, visual design, website content, and all associated materials are the exclusive intellectual property of the developer. All rights not expressly granted in these Terms are reserved.

You may not copy, reproduce, imitate, or create derivative works of the Nail Bite Beaver brand identity, including but not limited to the logo, beaver character, color scheme, website design, or marketing materials, without prior written consent from the developer. Unauthorized use of any Nail Bite Beaver intellectual property will be pursued to the fullest extent of applicable law.

13. Open Source Acknowledgments

Nail Bite Beaver incorporates open source components, including Sparkle (used for update checks on direct downloads). Full license texts for bundled open source components are included with the Software distribution where required. The use of these components does not imply endorsement by their respective authors.

14. Refund Policy

If the Software fails to function on your supported device, email us at support@nailbitebeaver.com and we will work to resolve the issue or provide a refund. We might ask for a short video or screenshot showing the issue to help diagnose the problem.

Separately, promotional refunds or discounts for posting Reels are governed by the offer terms described on the discount page. Those promotions may end at any time.

15. System Requirements

Nail Bite Beaver requires macOS 15 (Sequoia) or later and a Mac with a working camera. Apple Silicon is recommended. The developer is not responsible for issues arising from use on unsupported hardware, operating system versions, or devices without a functioning camera and camera permission.

16. Privacy

Camera frames are processed on your Mac and are not uploaded by the Software. License validation and (on direct downloads) update checks may involve limited network requests. For full details, see our Privacy Policy.

17. Marketing Communications

When you purchase Nail Bite Beaver, your email address is collected as part of the transaction (via Lemon Squeezy or the Mac App Store, as applicable). By completing a purchase and not requesting a refund, you agree that the developer may use your email address to send occasional marketing communications, including but not limited to product updates, new features, promotions, and related announcements.

Every marketing email will include a clear and easy way to unsubscribe. Once you unsubscribe, you will no longer receive marketing emails, though you may still receive transactional emails related to your purchase (e.g., refund confirmations or license recovery).

The developer will not sell, rent, or share your email address with third parties for their own marketing purposes.

18. Changes to These Terms

The developer reserves the right to modify these Terms at any time. Changes will be reflected on this page with an updated date. Continued use of the Software after changes constitutes acceptance of the updated Terms.

19. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which the developer resides, without regard to conflict of law principles.
